1. Introduction
These terms govern the use of this application (Squibler), its services, and any related agreements with Squibler Inc., Serena Rd. Lakeside, California 92040 (US). By using this application, users agree to abide by these Terms.
2. Account Registration & User Responsibilities
Users must provide accurate, complete, and current information when registering for an account. Users are responsible for maintaining the confidentiality of their credentials and must promptly report any unauthorized access. Squibler is not liable for any breaches resulting from user negligence. Users must be at least 18 years old to create an account. Providing false, outdated, or incomplete information may result in immediate account suspension or termination at Squibler’s discretion.
3. User-Generated Content & Ownership
Users retain full ownership of all content they create, generate, or upload, including AI-generated text. Squibler does not claim any rights, ownership, or usage over user-generated content. Users grant Squibler only the necessary rights to process and store content for service functionality. Users are solely responsible for their content and must ensure it does not violate third-party rights or laws. Squibler reserves the right to remove or restrict access to content found to be in violation of these terms.
4. Service Usage & Restrictions
Users may not engage in any of the following activities:
- Violating any applicable law or regulation.
- Infringing upon third-party intellectual property rights.
- Distributing harmful, offensive, or unlawful content, including but not limited to:
- Sexual content involving minors or bestiality.
- Graphic violence, gore, or torture.
- Hate speech or harassment targeting protected groups.
- Encouragement of self-harm or suicide.
- Unauthorized sharing of personal or confidential information.
- Attempting unauthorized access to Squibler’s systems, networks, or other users’ accounts.
- Circumventing or disabling any content-safety filters or moderation mechanisms.
- Each user is limited to one free trial. Refunds are not available for additional trials or duplicate subscriptions.
Permitted Adult Content
Notwithstanding the foregoing prohibitions, Squibler expressly permits the following content provided that it does not otherwise violate these Terms:
- Consensual, adult-oriented erotic or romantic scenes, in which all participants are at least eighteen (18) years of age and have affirmatively consented.
- Graphic depictions of violence or gore involving consenting adults.
Squibler reserves the right, in its sole discretion, to remove or restrict any content that it deems to be obscene, excessively explicit, or otherwise harmful, even if it falls within the scope of “Permitted Adult Content.”
Squibler reserves the right to investigate violations of this Section and to take appropriate action, including content removal, account suspension, or termination.
5. External Resources & Third-Party Services
Squibler may include links to third-party services. Users acknowledge that Squibler is not responsible for the content, practices, or reliability of external services. Interactions with third-party platforms are at the user’s own risk.
6. Subscription & Payments
Some services require payment. Fees, billing cycles, and conditions are outlined during purchase. Users must ensure timely payments to maintain access to services. Cancellations must be processed via user account settings or by contacting support. Refunds follow applicable consumer protection laws. Squibler may modify pricing with prior notice.
7. Right of Withdrawal (for EU, UK & Brazil Users)
Users in eligible regions may withdraw from paid services within:
- 14 days (EU & UK)
- 7 days (Brazil)
- 7 days (Rest of the world)
Withdrawal requests must be submitted before the period expires. Refunds exclude costs incurred from prior usage of the service.
8. Liability & Indemnification
Squibler provides services "as is" without warranties of uninterrupted access or error-free operation. Users agree to indemnify Squibler from claims arising from their content or misuse of services. Squibler is not liable for:
- Loss of data
- Indirect, incidental, or consequential damages
- Service interruptions beyond Squibler’s control
9. Intellectual Property
All proprietary content, trademarks, and software on Squibler remain the exclusive property of Squibler or its licensors. Users may not copy, distribute, or modify any proprietary materials without explicit permission.
10. Privacy & Data Protection
User data is handled as per Squibler’s privacy policy. By using the service, users consent to necessary data processing for service functionality. Squibler implements reasonable security measures but cannot guarantee complete protection against unauthorized access.
11. Content Safety & Reporting
Squibler implements and maintains robust content-safety and moderation procedures, including automated and manual reviews to identify and remove prohibited content (e.g., material involving minors or other unlawful content). Users may report any concerns via **info@squibler.io.** Squibler refers any suspected child sexual abuse material (CSAM) and other illegal content promptly to law enforcement and relevant authorities. Violations of these provisions may result in content removal, suspension, or termination of user accounts.
12. Modifications to Terms
Squibler reserves the right to update these terms at any time. Users will be notified of significant changes, and continued service use constitutes acceptance of revisions.
13. Governing Law & Dispute Resolution
These terms are governed by the laws of California, USA. Disputes shall first be addressed through amicable negotiation. If unresolved, legal proceedings will take place in the jurisdiction of Squibler Inc. Exceptions apply for European and UK users, who may access alternative dispute resolution mechanisms.
